The Hearing: Open Thread

It’s quarter to ten and I would normally be posting a new column, but in addition to being laid up and distracted by shingles-related pain this week (and grief from losing my grandmother over the weekend—and worry about my dad who had emergency surgery a couple days ago), I am ENRAGED by Brett Kavanaugh’s likely confirmation even in light of four allegations of sexual assault and misconduct against him. I know many of you feel the same rage and need and want a place to express and share some of that. Christine Blasey Ford is set to testify in a few minutes in front of the Senate Judiciary Committee about her allegation that Kavanaugh attempted to rape her when they were in high school. She says she’s terrified but is doing this because it’s her civic duty. I consider her a hero and stand with her in solidarity, as well as with all victims of sexual assault and harassment and misconduct, including those who suffered at the hands of men who have been awarded positions of power and celebrity despite their abhorrent treatment of women.

I’ll be watching the hearing live on TV at home, and I assume many of you will be following along today as you’re able to from work or home or wherever. This is an open thread to share your thoughts and vent your anger if you want to.

      I’m trying to get on with my day. It’s my husband’s birthday and I have things to do. I’m crying, instead. Part of me wishes her testimony to just be over and done. But I’m so glad at least she has an opportunity to talk about what happened to her.

      On the surface, it’s so the GOP can claim that she was heard, there was a fair process, they care, blah, blah, blah…in reality, it’s an exercise by the GOP to try to humiliate her while she discusses a horrible event in her past, then claim they don’t believe her and confirm Kavanaugh anyway, thereby proving once and for all that they don’t give a shit about the abuse of women while also making it (even more) clear that we should know our place and shut the fuck up about the systemic abused of women already. I don’t even know a name for the helplessness, fear and rage I feel about this. Or the sorrow that I feel knowing that my nieces will grow up not having nearly the same autonomy or choices that I have had.

      The Senate Judiciary Committee will consider her testimony and the testimony of Brett Kavanaugh when they vote on whether Kavanaugh’s nomination should or should not be moved to a full senate vote on his confirmation to the Supreme Court. The Senate Judiciary Committee is made up of 21 senators (11 republicans – all men, and 10 democrats).

Well, the democrat members are; the republicans are cowards who thought they’d look like bullies questioning her so they hired a woman to ask the questions for them. They are scheduled to vote tomorrow.

    This has been a pretty big news story in Canada. Most people I speak to are shocked/disgusted that the nomination hasn’t been pulled. My work has a TV at front reception where we play the news, and it’s been airing the testimony. A wealthy, white, FEMALE client just leaned in to me, shook her head, and said “It’s appalling how one crazy woman can destroy the career and reputation of a man like him.”

    I replied: “It’s appalling how a frat boy turd like him is being handed a chance to claw back women’s reproductive rights.”

    Pretty sure we just lost a client.

      It’s someone else’s description of him that I read earlier this week (maybe on Twitter), and now it’s all I think when I see his face. Haha!

      Seriously though, women who support him make me sick. It reminded me of a news story yesterday (I think on MSNBC?), during which a woman told a reporter, in front of her daughters, that groping “isn’t a big deal,” in reference to the accusations against Kavanaugh. Parents like her are why boys feel entitled and girls don’t report.

      Sorry guys, I still he’s getting confirmed.

      Republicans don’t care about women, and in their heart of hearts they don’t think what he did is wrong. Many of them have probably done similar shit.

      They do care about getting a conservative on the Supreme Court.

      This isn’t preferable and they know this will likely hurt them with female voters, BUT they were already looking at losses in the mid-term.

      Losing the house and maybe the Senate is reversible, a Supreme Court confirmation will have an impact for decades.

      Confirming a conservative (any conservative) justice is going to be much harder after the mid-terms.

      This is their best shot. They’re going to do it.

      I’m not saying I like it at all, but I think its the way its going to happen.

        I mean, I could be wrong, I’m not anyone special here nor do I have any special insider knowledge, but if I were a Republican senator and I were looking at long term vs short term gain, I’d probably decide it was worth it to jam through a friendly justice before that opportunity goes away, which it will regardless of what happens in this hearing.

        And neither Collins or Murkowski is up for reelection.

        So that could go either way – they may feel sheltered to make their decision freely and in line with their conscious. They may ALSO feel empowered to make that long-term choice knowing their seats aren’t on the line, in four years the electoral landscape will have moved on.

        The one way I could see this going is that Kavanagh might withdraw given the “distraction” and “strain” on his family.

        But honestly – what does he go back to?

    I live in Canada too-although that really is not relevant,lol. The Reps are attributing all this “evil conspiracy” to the Dems. This is because if the situation were reversed this is how Reps would act-they believe in their agenda more than what is right or wrong IMO. They supported that corrupt,sexist, lecherous, brainless Trump despite what a horrible human,let alone president he is.
    I like to think the Dems are more trying to do what is right. Anyway,these accusers are believable and obviously distraught. Why would they ruin their own lives for a political cause? No one would. This”boys will be boys” attitude has got to stop-it is sad when even some women buy into that…

    Christine Blasey Ford testimony sounds similar to what happened to be 25 years ago at the age of 16. Going to a small gathering back then they were called Kick-Backs. Someone I knew forced me into a room and and tried to pull my pants down. The terror still lives inside me, it’s something you cant forget. Laying on the floor in a state of panic and fear holding on to my jeans with all my strength while trying to scream for help in hopes someone would hear me. I’m so thankful the friend I had gone with opened the door and took me home.
    One of the scariest moments of my life.
    I never reported it because of fear, the only people I have shared my story with are my daughters.
    I’m so glad and feel so proud that women are finally standing up for themselves, wish I would have done the same. You weren’t rape so who cares, not a big deal mentality needs to stop, it’s still abuse.

    This whole thing is basically a playbook on how NOT to run a nomination campaign. I mean, they went through this before with Clarence Thomas! How do they NOT know how to fight this properly?

    Let’s be frank here: if he had said when this allegation first came forward, “I don’t recall ever doing what I’ve been accused of, but I will not begrudge the victim her feelings, and if I have hurt this woman in any way then I am sorry for the pain I’ve caused her and hope my actions moving forward will reflect that.” (or something to that effect), it would still be a mealy-mouthed BS response, but it would have shut this shit down from moment 1 and he’d have been confirmed already. End of story.

      They know how to fight this properly. They know that the base doesn’t care or is positively invested in the idea of making men of a certain class/status unaccountable for what they do . They know that they have at least 50 votes that aren’t especially interested in getting to the bottom of this and will confirm as they have the barest plausible deniability.

      I’m sure you’ve checked out again, but Kavanagh is not on trial. The concept of “innocent before proven guilty” really only applies to a very narrow application – the presumption that people are innocent of crimes and therefore cannot be charged and punished until proven guilty. In this one specific application – to deprive someone of a fundamental civil right and remove their freedom – we must meet that bar.

      Innocent before proven guilty doesn’t apply to how the public views you. It doesn’t apply to whether you can be denied a job if there are questions about your character and conduct.

      There is no need to presume Kavanagh’s innocence, because he is not being charged for a crime. Rather, his character and moral fiber is being evaluated in order to judge his fitness for a job, and he could potentially be found lacking and therefore unqualified based on Ford’s (and other women’s) testimony alone.

    I am so mad!! I am mad that these women are being attacked because they are coming forward. I am mad that the women who accused Bill Cosby (America’s grandpa) were believed but these women are vilified. (I believe them all). It makes me sick to my stomach to hear other women vilify Dr. Ford, or say groping is no big deal. I am mad that his jobs are supposed to convince us that he is a good guy. I am FURIOUS that this hearing even needs to happen, and the crocodile teared ass hat will probably still get nominated.
    I have been in her position, I was drugged and raped on a date and lost a friend because her first question was ‘if you blacked out, are you sure you didn’t say yes?’ it makes me sick to know my rapist got away with it and so will this scum bag.
    I am so tired of feeling attacked, as a POC, as a woman, as a democrat, as a survivor, I am tired. I feel exhausted at every new, gross thing that comes out of this administration.

        That’s a good point, those women fought years to get justice. I lost sight of that in light of him sitting in jail. It just makes me sick that some women seem to gleefully pull other women down. When I watched Dr. Ford speak I was crying in my office because I know that feeling, and I don’t think I could testify in a room of people looking to discredit me. Her bravery honestly floored me.

        Thank you, I am blessed with a wonderful support system other then the former friend. She has a past also, and her own demons to fight along these same lines. Our friendship didn’t really survive her victim blaming, but she has my sympathies.

    NOW HE KNOWS WHY WOMEN DON”T COME FORWARD.

    This emotional rollercoaster that he’s on – where he has to answer questions from hostile men, who repeat the same question until he fucking answers… this is what women go through when they’re questioned. Where his back is up against the wall and for the first time he finally feels like perhaps not everyone in the room is on his side.

    He can’t handle the pressure as a 40+ year old man, imagine being a 16 year old girl.
    God I hope he has a heart attack and dies on the Senate floor.

        I think the holdouts may ask for FBI investigation before moving forward. That July 1st calendar entry, brewskis at Timmy’s with Mark Judge and PJ looks mighty interesting. Ford didn’t know about that when she wrote her letter. Also, he told obvious lies up there about Devils Triangle, Boof (urban dictionary anyone? It wasn’t around in 1982), and the Renate Dolphin reference. Like Blumenthal said, false in one thing, false in everything. He just wasn’t credible enough, and Ford was.

        This makes me incredibly sad. I was sexually abused for many years as a child. Over and over again. I finally told my mom when I was 11 and I remember the trauma of having to tell the police everything and my mom wasn’t allowed to be with me. The police kept asking me questions and I just kept saying “I don’t remember” over and over and over because I was so scared and so ashamed.

        When I was a teenager, my mom applied to the Criminal Injuries Compensation Board to try to get some sort of compensation for me. There was a hearing, which was terrifying. But the worst part wasn’t telling me story to the judging panel, it was the lawyer cross examining me. Asking me how many times I had initiated sexual contact with my abuser and implying that I enjoyed it. I was a little child. I hadn’t even gone through puberty yet. What kind of person do you have to be to imply in court that a little child wanted this to happen to her? And I’ve often wondered how that man sleeps at night and what his wife thinks of him.

        Reliving traumas in court is horrible enough, but having your words twisted and turned back on you in any way possible to discredit you and make you look stupid is worse. And that is why women don’t come forward.

    I tried to watch the hearing yesterday but was on the verge of tears before Chuck Grassley even finished his opening tirade. I had too much work to do to be a total emotional mess, so I followed on a live blog instead. Still infuriating and triggering. I watched bits and pieces after I got home, and I just cannot fathom how anyone could watch his testimony and find him credible. He’s the picture of white (hetero cis-) male entitlement, whining because he’s being held accountable for his shitty behavior for the first time in his entire life. I also see the ABA is calling for a postponement for an FBI investigation, along with Alan Dershowitz, who is a total right-wing shill at this point. The committee vote is at 10:30, but I have a meeting at 10:00, so I’m hoping for good things after my meeting.

      I read in a NYTimes article that RAINN’s phone line traffic went up by about 500% yesterday, from 6-8 people in queue to 45-50 people, talking about assaults they’d endured years ago but never reported.

    Even if you accept the Republican’s claim that the Democrats have been scheming to push the vote past the mid-terms (projecting much? And why would Dems even want to do that, the lame-duck R senate can confirm and I think to confirm this seeming attempted rapist in a rush would be an electoral boon to Ds), what they are saying is that they are putting their perception of procedural violations by Dems ahead of justice and the truth.

    Premature post, touch-pad had mind of its own.

    The whole thing about a delay past mid-terms of Kavanaugh is bogus. There is WAAAY more time than necessary to investigate, have the Judiciary Committee meet to assess results of investigation, and confirm Kavanaugh, IF the facts check out in his favor.

    That’s a big IF, and I think the Republicans think Kavanaugh might be guilty as accused. The time-crunch to the mid-terms only arises if an investigation shows Kavanaugh probably is an attempted rapist. In that case, he can’t be confirmed and the Rs don’t have enough time before mid-terms to confirm the next choices. That’s the real issue. The complained about time crunch only happens if the Rs are forced to admit that Kavanaugh is guilty.

    They blame a vast conspiracy and the leak of the letter on Senator Feinstein or her staff, but The Intercept has said that’s not where their information came from. So, today they switched to blaming the lawyers. It’s an ever-evolving grand conspiracy.

      Yes, they can investigate anything they want. Mitch McConnell’s office indicated the scope is not limited to the Ford allegations. But keep in mind, they don’t even need to prove anything about sexual assault. It would be enough just to prove he lied to senate (perjury = federal prison).

    There are senate races going on in places like Montana and North Dakota where donations would go a long way. These races will determine control of the senate going forward. If you are able to donate please consider to doing so.

    I know it doesn’t mean much, but I’m sorry to everyone who has had to watch this and have their own memories of assault and abuse dredged up. I’m sorry to everyone who hasn’t but has had to bear the daily mental and emotional burden of policing their own safety against sexual assault because society didn’t treat it as the urgent and necessary threat to half the population that it always has been. I’m sorry that my moral imagination has for most of my life been too weak to internalize threats to others the way that it does to myself. The last few years has been eye opening in this respect.

        Unfortunately, we have a right wing conservative congressman. The only good thing about him is that he is terribly lazy so he doesn’t do much. He never introduces legislation. He does vote party line.

        I really want to donate to close races where some extra money could be put to good use.

    Here’s a heartbreaking article about 12 women from Catholic prep schools at the same time and same area as Kavanaugh and Ford. They were raped and assaulted too and thought they were alone until Ford spoke up. They talk about why they would never have said anything.

    It’s really looking like Georgetown Prep had a disgusting rape culture that’s been kept quiet by the boys. I want this to be blown wide open.

    The thing that has stuck with me after watching Kavanaugh testify was the controlled rage. Abusers use rage to dominate and control a situation to get what they want.

    He’s an abusive man.
    He lies easily.
    He’s highly partisan.

    He knows which buttons to push to rile up the republican base. Infering that the entire situation was created by the Clintons to get even with him was part of that. The republican base is still foaming at the mouth with rage over the Clintons. They are still publishing books about the Clintons.

      I agree with this. It’s so pathetic to have brought politics into it. That alone should disqualify him from the Supreme Court.

      I think he was coached into displaying anger because so much feedback from that Fox interview mentioned how emotionless he was in his canned, repeated comments.
      It’s a stark contrast to Dr. Ford, who had to toe the line and be incredibly mindful and calm with her testimony. If she displayed emotion like that, she’d be ripped apart for being hysterical.

      I’m hopeful for the investigation.

        I think he is actually a nasty, misogynist, extreme partisan but I also believed he used some faux anger to filibuster and refuse to answer the questions from the Democratic senators. He basically gave his angry, petulant opening remarks, gave carefully scripted answers to the carefully scripted questions from the Republican senators and their outside counsel and stonewalled everything else. To say he submitted to questioning is, well the accurate word is farce. He was apparently told to fully display his scorn for the Dems and not answer their questions so he couldn’t get himself into more trouble.

    I’m proud of Senator Jeff Flake for requesting an FBI follow-up. Maybe an investigation can help collaborate testimony from the trial. Except for Lindsay Graham, I thought the Senate members on the whole were respectful towards Dr. Ford while she was testifying.

      I didn’t watch all of Judge Kavanaugh’s questions. I found the difference of opinion around his answers interesting. There seems to be a large swath of people who thought his passionate response was brave.

      I thought he sounded like he was using male bonding whistles (not dog, because those are less obvious).

      I grew up in a home where nothing worked better or more effectively to shut a conversation down than an emotional male. If a man felt angry, it was an instant sign that things had gone too far. There was nothing my most misogynistic family ever responded to more than watching a powerful male in a vulnerable position. Rage is the only emotional response which garners any respect.

      I’m glad some members of the senate are taking Dr. Fords testimony, seriously. If Mike Judge isn’t willing to break the Catholic bro-code, I think he will be confirmed. But I think it has sent a strong message that men aren’t going to be reflexively put in lifetime positions without real scrutiny and discernment towards their attitudes and choices at other people’s expense.

      I wish Judge Kavanagh had watched Dr. Fords testimony. My guess is he is afraid he might actually start remembering details and then he couldn’t answer truthfully without hemming and hawing about his crappy youthful behavior.

      I was 20 years old and barely followed politics at the time and Clinton was running for a final term the would last four years, so no, I wasn’t as enraged as I am now as a politically and civically-engaged 42-year-old watching a sexual assailant being handed a LIFETIME seat on the Supreme Court. You know what I think of Clinton now, though? I think he’s a dog! I would never want him on the Supreme Court, for his behavior toward women, alone. But even if we were to forget how both of these entitled white men have treated women — which we shouldn’t! — Clinton at least as the temperament of a leader. The performance Kava-not gave at the hearing looked like he was mentally disturbed and belligerent. Not qualities any judge should have, let alone a judge on our highest court.
